Please read these Terms of Service carefully. They govern your use of vinrent.vn and our booking channels (website, Telegram bot and chat, together "the Services") and form part of every car rental you make with us.
1. Who we are
The Services are operated, and cars are rented, by CÔNG TY TNHH VINRENT, a limited liability company registered in Vietnam, Lô 21 LK8-5, Đường 16, KĐT Mỹ Gia, Gói 8, Nha Trang, Khánh Hòa (Enterprise/tax code 4201999822; legal representative: Bùi Ngọc Bá Hải) ("VinRent", "we", "us"). Contact: [email protected] · +84 258 730 0336. Office hours: daily 08:00–20:00 (Vietnam time, ICT). Roadside assistance for renters: 24/7.
We are a car rental company: we own or control the vehicles we rent and are your contracting party. We are not an insurer and do not sell insurance.
2. Documents that apply
Your rental is governed, in this order of priority, by: (1) the Rental Agreement signed for your booking; (2) the policies referred to in it — Cancellation Policy, Non-Smoking Policy, Pet Policy; (3) these Terms of Service; (4) our Privacy Policy and Cookies Policy. If they conflict, the earlier prevails. By making a booking, ticking the confirmation box or collecting the car, you accept them.
Rental services are currently provided in Nha Trang and Cam Ranh airport, Khánh Hòa province.
3. Your account and the information you give
You must give accurate and complete information and keep it up to date. Keep your login details secret; you are responsible for activity under your account and must tell us at once about unauthorised use. We may refuse or cancel a booking, or refuse to hand over a car, if information is false, documents cannot be verified, or the rules below are not met.
4. Who may rent and drive
- The renter must be an adult with legal capacity, present at hand-over with an original passport or ID and a valid driving licence of the appropriate category. A foreign licence is accepted together with a certified Vietnamese translation, which we provide free of charge. Requirements as to age and driving experience for a particular car are shown at booking.
- Only the renter and additional drivers approved by VinRent in writing may drive. Each driver must meet the licence requirements.
- Driving without a valid licence, or by an unapproved driver, voids the damage waiver (see section 10).
5. Booking, prices and payment
- Availability. A booking is confirmed once we confirm it and the required advance is paid. We may offer an alternative if the car becomes unavailable.
- Prices. Prices are shown in Vietnamese dong (VND); other currencies are shown for information at the rate on the site. The total shown before you confirm includes VAT (7%) and the options, services and situational fees that apply to your booking — for example delivery, one-way return, hand-over outside office hours, or a booking made less than 24 hours before pick-up. Prices are fixed at booking. Other than as set out in the Rental Agreement (traffic fines, penalties, damage, late return and similar), no further rental charges arise.
- Payment in parts. The total is paid in separate transactions: a booking advance (counted toward the price), the rental balance, and a security deposit. Online methods and cash (where offered) are listed at checkout.
- Processing fees. The fee of your chosen payment method is added to that transaction and is not refundable.
- Pay on pickup. If offered and chosen, a pay-later premium shown at booking is included in the price.
- Security deposit. The refundable deposit secures your obligations (damage up to the excess, fines, penalties, late return). Deductions are made only for documented items, with an itemised statement, and the balance is returned within the period stated for your protection plan to the original payment method (in cash, if paid in cash).
- Disputes with your bank. If you file a chargeback for an amount properly owed, we may recover the amount and our reasonable costs from you.
6. Cancellation, changes, early return
See the Cancellation Policy. In short: free cancellation until the time shown for your booking; the booking advance is not refundable; later cancellation and no-show forfeit the rental payments; early return gives no refund.
7. Hand-over and return
Hand-over and return are video-recorded. Inspect the car at hand-over and note any existing damage; you confirm it is in good order. Risk passes to you for the rental period. Return the car at the agreed time and place in the condition received, normal wear excepted. Late return: up to 2 hours after the end time is free; beyond that, each started 24 hours is charged as a full rental day at your booking rate. Cars are equipped with GPS and a dashcam; you consent to their operation during the rental.
8. Using the car
You must: observe Vietnamese traffic law; drive with zero alcohol and no drugs; keep the car locked and the keys and documents safe (loss is compensated at documented replacement cost); pay parking, toll and traffic charges arising in your rental; keep the car in Vietnam.
You must not: sublet or lend the car; use it for taxi or ride-hailing, racing, driving lessons, towing or off-road driving; carry dangerous, illegal or excessive loads; smoke or vape in it (Non-Smoking Policy); carry animals other than as the Pet Policy allows; take it outside Vietnam (crossing into Cambodia, Laos or any other country is prohibited); modify it or fit non-approved accessories.
9. Traffic violations and penalties
You are responsible for all fines and consequences of violations during the rental, including those notified after return. Violations can be established from GPS and dashcam data and official notices. In addition to state fines, contractual penalties set out in the Rental Agreement apply for serious violations (for example speeding and running a red light). We may end the rental without refund for dangerous driving.
10. Protection plans and liability for damage
Protection is not included in the base rental price; you choose a plan at checkout, and each plan has an excess — the maximum you pay for covered damage — shown before you pay. These plans are a contractual limitation of your liability granted by VinRent; they are not insurance. The car carries the compulsory civil-liability insurance (TNDS) required by Vietnamese law.
The limitation does not apply, and you bear the actual loss, where the damage or loss results from: alcohol or drugs; an unapproved driver or no valid licence; use contrary to section 8; leaving the scene of an accident; failure to follow the incident procedure below; deliberate damage or gross negligence. Damage not covered by your plan (for example tyres, glass or underbody, depending on the plan) is charged at the documented cost of repair.
11. Accidents, breakdowns and theft
In an accident, damage or breakdown: make everyone safe; call VinRent (+84 258 730 0336, 24/7) and, where required, the police (113); do not move the car until we tell you; take photos and video; obtain a police report where relevant. Report theft or loss of the car immediately to us and to the police. Failure to follow this procedure voids the limitation of liability. If the car becomes unusable through no fault of yours we will repair or replace it, or refund the unused days.
12. Our liability
Nothing limits liability that cannot be limited by law, including for death or personal injury caused by our fault or for consumer rights that cannot be waived. Subject to that, and to the extent permitted by law, we are not liable for indirect loss (such as lost bookings, missed flights or lost profit), for loss of personal belongings left in the car, or for interruption of the Services or delay caused by events beyond our reasonable control (weather, road closures, government action, network or power failure, force majeure). Our total liability for a rental is limited to the amounts you paid for that rental, except for our wilful misconduct or gross negligence. We are not responsible for the content of third-party sites that we link to.
13. Website use and intellectual property
The Services and their content (texts, design, logos, software) belong to VinRent or its licensors and may be used only for your personal, non-commercial purposes. You must not scrape or copy content in bulk, interfere with the Services, attempt unauthorised access, use them unlawfully, or post unlawful or misleading content in reviews or messages. Third-party photographs are credited on the Image credits page. Reviews you submit may be displayed on the site.
14. Personal data
We process personal data as described in the Privacy Policy. You consent to the recording of hand-over and return and to GPS and dashcam data being used to perform the contract, deal with incidents and violations, and as required by law.
15. Suspension and termination
We may suspend access to the Services or end a rental, with a refund only where these Terms say so, if you seriously breach the Agreement, endanger people or the car, or give false information. You may stop using the Services at any time. Terms that by nature continue (payment, liability, data, disputes) survive termination.
16. Governing law and disputes
These Terms and each rental are governed by the laws of the Socialist Republic of Vietnam. Please contact us first — we will try to resolve any complaint by negotiation, normally within 30 days. If that fails, the dispute is decided by the competent court of Khánh Hòa province, without affecting any mandatory consumer rights you have under the law that applies to you.
17. Changes and general provisions
We may update these Terms and the policies; the date at the top shows the current version. Changes apply to bookings made after they are published; an existing booking is governed by the version in force when it was made. If a provision is held invalid, the rest remains in force. Our failure to enforce a right is not a waiver. You may not transfer your rights under a booking without our consent. The Terms are made in several languages for convenience; in case of difference, the Vietnamese text prevails, then the English text.
