Version v2026.10.4 · applies to bookings made from 2026-10-13. Amounts and periods that depend on your booking are shown in the Rental Card and in the order summary before payment; they are not repeated here.
1. The parties, key moments and the documents that make up the contract
1.1. The lessor is CÔNG TY TNHH VINRENT, Lô 21 LK8-5, Đường 16, KĐT Mỹ Gia, Gói 8, Nha Trang, Khánh Hòa; enterprise code 4201999822; legal representative Bùi Ngọc Bá Hải; [email protected]; +84 258 730 0336 (hereinafter VinRent, "we"). You always enter into the contract with VinRent. The car may belong to a VinRent partner and be handed to us for rental; for you this changes nothing — the contract, the settlement of damage and responsibility towards you are always with VinRent.
1.2. Conclusion of the contract and start of the rental. Once, before the first payment, you have been given access to the documents, have accepted them and have made the first payment required by the booking, VinRent confirms the booking and records the individual terms. From that moment the parties are bound by the confirmed booking terms. Before the car is handed over you sign the Rental Card: it individualises terms already agreed and may not add new obligations or worsen the terms previously accepted without your separate consent. The period of actual use of the car, and the related risk, begins when the car is handed over under the handover record. The legal moment at which the contract is concluded is determined by applicable Vietnamese law; the sequence described above does not limit any consumer right that arose earlier.
1.3. If we do not hand over the car through our fault (no car available, a malfunction, a verification error that we ourselves approved before payment), you receive a full refund of everything paid, including the advance, or an equivalent replacement, at your choice.
1.4. Documents and their priority. The contract consists of: the Rental Card; the document "Booking, Payment, Cancellation and Refunds"; the document "Protection Plan"; the document "Vehicle Condition and Damage"; the document "Additional Options and Services"; these General Terms; the Privacy and Telematics Policy. For individually agreed matters the Card applies first; for their own subjects the topic documents apply (money — "Booking, Payment, Cancellation and Refunds"; what falls under the plan — "Protection Plan"; how damage is proven and calculated — "Vehicle Condition and Damage"); then the General Terms. If any doubt remains, it is interpreted in favour of the consumer.
1.5. All documents are shown and available for download before the first payment. We keep the texts of the versions accepted, their checksums, the time and language of display and the time of acceptance. You receive the set of accepted documents together with the signed Card.
1.6. Language. The contract is drawn up in Vietnamese and in your language. The Vietnamese text is the primary one; the translations convey the same meaning. If the language versions differ, the version more favourable to the consumer under the mandatory rules of Vietnamese law applies. The documents record the languages in which you saw and accepted them.
1.7. Changes. A new version of the terms applies only to bookings made after its publication. A booking already made is governed by the version you accepted. The exception is changes that we agreed with you after the booking (an extension, a different car, an additional driver, a different protection plan); they are recorded in an addendum to the Card.
2. Who may rent and drive
2.1. The Renter is a person of full legal capacity and of full age. The minimum age and driving experience are set for each car, are shown when you choose it and are recorded in the Card before payment. If the owner or the insurer of the car sets additional requirements for the driver, they are stated in the same place.
2.2. Driving licence. Only a person who has the right to drive in Vietnam may drive: (a) a Vietnamese licence of the required category; (b) an International Driving Permit (IDP) under an international convention to which Vietnam is a party, together with the national licence of the country of issue, which must be valid and either contain the data in Latin script or be accompanied by the IDP; (c) a licence issued by an ASEAN member state. We do not accept translations or their certified copies in place of these documents.
2.3. Check before payment. Before payment you state the country of issue, category, validity period and type of licence of each driver. If it is clearly unsuitable, the site will not accept the payment. If a manual check is needed, we will tell you before payment. If we approved your details before payment, we may not refuse handover on the basis of those same details — such a refusal is treated as our fault (cl. 1.3).
2.4. Additional drivers. Only the Renter and the drivers named in the Card may drive. Each goes through the same check and personally confirms their details and their right to drive (by link or on a tablet at handover). The Renter is responsible for the person to whom they hand over driving.
2.5. Licence statement and its consequences. The Renter and each additional driver represent and warrant that the licence is valid, the details are correct and the original will be shown to VinRent before handover. If this is not so, one of three rules applies:
| Case | What we do | Money | |---|---|---| | A. An error in the details, the licence is genuine and valid | We correct the details before handover | No loss | | B. The driver has no lawful right to drive (expired, wrong category, not recognised, original not shown), but the person was acting in good faith | We refuse handover to that driver; if there is another approved driver, we hand the car to them | If the rental did not take place: we refund everything except the advance; the deposit in full. If we approved the details before payment — a full refund under cl. 1.3 | | C. Knowingly false information (a forged or someone else's document, false identity) | We refuse handover and terminate the contract | The deposit is returned in full. VinRent may keep the advance and documented direct costs incurred because of the breach; other payments for services not provided are refunded |
If the refusal of handover is caused by our verification error, it is a case under cl. 1.3. The application of the protection plan does not end automatically because of an error in the details: the plan does not apply only where the car was actually driven by a person without a lawful right or by a person not named in the Card (document "Protection Plan").
3. Handover, return, territory
3.1. Handover. At handover we check the originals of the passport and driving licence and draw up with you the handover record (photos or video, mileage, fuel or charge level, existing damage). You confirm the record or enter objections. The keys are not handed over until the record is signed.
3.2. Period and risk. The rental period begins with the actual handover of the car under the handover record and ends when the car is returned to the agreed place and passes into VinRent's control. During this period the Renter bears the risk of accidental loss and damage — except for: normal wear and tear; damage already recorded in the handover record; hidden defects and faults not caused by the Renter; acts or omissions of VinRent; force majeure (section 8), if the Renter acted in good faith and followed our instructions.
3.3. Return. The car is returned on time and at the place stated in the Card, in the condition of the handover record, except for normal wear and tear. Acceptance is documented in a return record. If you refuse to sign the record, we record the condition with photos and video and send the record to you; you may object within the period set in the document "Vehicle Condition and Damage". A return outside working hours carries the situational fee shown before booking.
Remote return (without a staff member) is possible only if agreed in advance and stated in the Card. In a remote return the car is considered passed into VinRent's control at the moment when the Renter has simultaneously: (1) placed the car at the agreed place; (2) completed the mandatory photo and video checklist (all sides of the body, interior, odometer, fuel); (3) locked the car; (4) handed over the keys in the manner provided. From that moment late-return charges stop and so does the risk of later accidental damage or loss, except for damage that VinRent proves arose before the moment of return. VinRent carries out the initial inspection no later than 12 hours after a remote return. This period is VinRent's inspection period, not a continuation of the Renter's responsibility.
3.4. Late return. The first 2 hours after the agreed time are a grace period without extra charge; it is granted once per agreed return time. After that, 10 % of the daily rate of your booking is charged for each hour begun. For each 24 hours after the end of the grace period, the charge does not exceed one daily rate. The daily rate is stated in the Card. We warn you when charging begins.
3.5. Territory. By default the car is used in the rental region — Khánh Hòa province (Nha Trang, Cam Ranh airport and surroundings). Travel to other provinces of Vietnam is allowed only with the paid "Inter-regional trips" option (document "Additional Options and Services"), except for prohibited zones disclosed in advance. Crossing the state border (Cambodia, Laos or any other country) is always prohibited. Return at a different place is possible only if stated in the Card (for an extra charge). Accidentally crossing a provincial border does not automatically lead to a penalty: we contact you first.
3.6. Mileage. Each car has a basic daily mileage limit; its amount and the price per kilometre over the limit are shown when you choose the car, before payment, and are recorded in the Card. You can buy an extra package of "+200 km per day" or "+400 km per day". Mileage is counted as total mileage over the whole rental, not for each day. We do not promise "unlimited mileage".
4. How to use the car
4.1. You must: comply with Vietnamese traffic rules; not drive under the influence of alcohol or drugs (the permitted level is zero); lock the car, take care of the keys and documents; return the car in the same condition, except for normal wear and tear.
4.2. The following is prohibited: subletting the car or handing driving to others; using it as a taxi or for ride-hailing services; taking part in races; teaching driving; towing; off-road driving; carrying dangerous or illegal cargo and overloading the car; smoking and vaping inside the car; modifying the car. Animals are not allowed, except where required by law (an assistance animal of a person with a disability) or with VinRent's prior written consent.
4.3. For smoking and animals we deduct only the documented cost of professional cleaning and repair (the method is in the document "Vehicle Condition and Damage").
4.4. Telematics. The car may be equipped with GPS and a dashcam. What exactly is recorded, why, who has access and how long it is kept is set out in the Privacy and Telematics Policy; in the Card and inside the car you see a notice about it. GPS data is not used to charge a fee or to establish a violation automatically. If the system records a possible violation (for example, leaving the permitted territory), you receive a notification and an opportunity to explain the circumstances; the decision is made by a staff member after reviewing the data.
5. Fines, tolls, parking
5.1. A fine for a traffic violation during the rental is paid by the driver. We pass the driver's data to the authorities to the extent the law requires.
5.2. If a fine or notice is issued to the owner of the car and we have paid it, we recover the amount from you only if the time and place of the violation fall within the rental period, and we give you a copy of the decision and a copy of the payment. A single notice received during the rental period, without such a match, is not a ground.
5.3. Tolls and parking for the rental period are paid by the Renter, including charges that reach us after the return, on the same terms and with the same documents.
5.4. Fines, tolls and other charges that we learn of after the return we issue by a separate invoice or payment link within 90 calendar days after the car is returned, with documents. The deposit is not withheld for this beyond the periods in the document "Booking, Payment, Cancellation and Refunds".
5.5. No fine-processing fee is charged as of the date of this version. If one is introduced, it will be only with disclosure before booking, in the amount of the actual costs and without effect on bookings already made. There are no contractual penalties beyond official fines and documented costs.
5.6. Dangerous driving and termination of the rental are possible only on objective criteria: an official report or a decision of a public authority on a serious violation; an accident through your fault; driving while intoxicated; handing driving to an unapproved person; repeated documented violations after a written warning. Before termination we notify you in writing and give you the chance to respond, except in cases of immediate danger. On termination we refund the unused part of the payment less documented amounts.
6. Accident, breakdown, theft
6.1. First of all, ensure the safety of people, call the emergency services (police — 113, ambulance — 115) and follow the lawful instructions of the police. If it is safe and not contrary to the law, leave the car where it is and record the circumstances (photos and video, details of those involved, location). Tell VinRent as soon as possible: +84 258 730 0336, roadside assistance 24/7. Do not admit fault in writing and do not instruct third parties to repair the car without agreeing with us, except for urgent action to prevent further damage (moving the car out of a dangerous place and the like).
6.2. Report the theft or loss of the car to us and to the police immediately.
6.3. A breach of this procedure affects the application of the protection plan only to the extent that it actually made it harder to establish the circumstances or determine the amount of the damage (for example, there is no theft report).
6.4. A fault not caused by you. We choose and offer: repair, an equivalent replacement or — if neither is possible within a reasonable time — a recalculation and refund for the unused days, or termination. The costs of towing and emergency assistance for such a fault are borne by us. If the fault occurred through our fault, we reimburse your documented, reasonable direct costs of the forced solution (for example, a taxi to your accommodation).
7. Damage and the Renter's liability
7.1. You are liable for damage to and loss of the car during the rental in the amount of the actual direct damage, supported by documents, subject to the exceptions in cl. 3.2. Normal wear and tear and damage from the handover record are not charged to you.
7.2. Damage includes: repair (parts and labour); in the case of total loss or theft — the market value of the car immediately before the event, taking residual value into account; towing; vehicle downtime (under the rules of the document "Vehicle Condition and Damage"). Wear of replaced parts is taken into account. Double recovery for the same damage is not allowed, including where it has already been compensated by the car's insurer or by a third party.
7.3. If you have chosen a protection plan, VinRent waives part of its claims against you for damage — up to the limit of your plan and in the cases described in the document "Protection Plan".
8. Our liability and force majeure
8.1. We are liable in the manner and within the limits set by law. Nothing in the contract limits consumer rights that cannot be limited by contract.
8.2. Force majeure means circumstances that could not be foreseen and prevented and that objectively prevent performance (a natural disaster, road closure by an act of a public authority, other circumstances under the law). A party must promptly warn the other and confirm the circumstance. Without this it cannot be relied upon. There is no general exclusion of liability "for any decisions of the authorities".
9. Change, extension, early return, cancellation
The rules are in the document "Booking, Payment, Cancellation and Refunds". Changes by agreement of the parties are recorded in writing (site, chat, e-mail) and reflected in the current Card.
10. Termination of the contract
10.1. You may withdraw before handover — under the cancellation rules; after handover — by returning the car (early return — under the rules of the document "Booking, Payment, Cancellation and Refunds").
10.2. We may terminate the rental only on one of these grounds: knowingly false information (cl. 2.5 C); driving by an unapproved person or a person without the right; prohibited use (cl. 4.2) after a warning, if the breach can be remedied, or without one, if it threatens safety; dangerous driving (cl. 5.6); non-performance of payment obligations after a written demand. The notice is in writing, stating the reason.
10.3. Settlement: you return the car to the place indicated (if it is safe), we draw up a record and a line-by-line calculation, and refund the unused part of the payment and the deposit less confirmed amounts — within the periods in the document "Booking, Payment, Cancellation and Refunds".
11. Personal data
Personal data is processed only on a lawful basis and for purposes determined in advance, in accordance with the Privacy and Telematics Policy. The existence of a contract does not in itself mean consent to any processing of data. Where the law requires consent — including for the relevant kinds of location tracking, recording or optional analytics — it is requested separately and recorded. Refusing optional processing does not affect the possibility of renting. Marketing mailings are sent only with separate consent, with no pre-ticked boxes.
12. Complaints and disputes
12.1. Write to [email protected] or through the form on the site. We confirm receipt of your message within 3 working days — this is VinRent's internal standard. If the message is a demand for negotiation of a consumer dispute, we accept it and begin negotiations within the period set by applicable law — no later than 7 working days from receipt of the demand. You do not have to wait for our procedure to finish: at any time you may apply to a consumer protection authority, a mediator or a court.
12.2. The contract is governed by the law of the Socialist Republic of Vietnam. If a dispute cannot be resolved by negotiation, either party may apply to a competent court or another body provided by law. Nothing in the contract limits your right to go to court, to mediation and to a consumer protection authority.
13. Electronic conclusion and signing
13.1. The contract is concluded in electronic form. For each signatory the signing log records: the document identifier and its hash, the version, the signatory identifier, the method of identification and signing, the date and time, the technical data of the electronic signature service provider (VNPT eContract), the certificate details — if one was used — and the final signed file. The method of signing and identification is described in the "Notice on Electronic Signing and Communication". The use of a one-time code (OTP), eKYC, SmartCA or another method does not mean their automatic legal equivalence: only the process that VinRent and the provider have confirmed as permissible for the particular signatory applies.
13.2. You receive the signed copy by e-mail and can download it in your personal account.
14. Notices and general provisions
14.1. Notices. We write to you at the e-mail and phone number from the Card, in your personal account, in Telegram or in the chat on the site. You write to [email protected] or through your personal account. Important notices (about damage, termination, deduction from the deposit) are sent by e-mail and duplicated in the account.
14.2. If part of a term is held invalid, the rest remains in force. Our not exercising a right does not mean a waiver of it. You may not assign your rights under the booking without our consent, except rights that the law allows to be assigned without consent.
