This page shows the standard form of the Car Rental Contract that VinRent signs with every renter. The binding, personalised contract for your booking — with your details, the car, dates, price and payments — is generated after your booking is paid in full and signed electronically through VNPT eContract. Electronic signatures and timestamps have full legal force under Vietnamese law on electronic transactions. The contract is bilingual (Vietnamese and your language); the two texts are identical in substance and the Vietnamese text prevails. Amounts in curly brackets are filled from your booking.
1. Parties
Lessor: CÔNG TY TNHH VINRENT, Lô 21 LK8-5, Đường 16, KĐT Mỹ Gia, Gói 8, Nha Trang, Khánh Hòa (Enterprise/tax code 4201999822; legal representative: Bùi Ngọc Bá Hải) · [email protected]. Renter: the person named in the booking, identified by passport or ID number, with contact details, and holding a driving licence of the appropriate category valid in Vietnam (a foreign licence is accepted with a certified Vietnamese translation provided free of charge). Only the renter and drivers approved by VinRent in writing may drive.
2. Lessor's obligations
VinRent hands over the car in roadworthy condition, with the documents required for its operation in Vietnam and the compulsory civil-liability insurance (TNDS). It provides roadside assistance 24/7; the office is open daily 08:00–20:00 (ICT). If the car becomes unusable through no fault of the renter, VinRent repairs it or provides a comparable replacement; if neither is possible within a reasonable time, it refunds the rental price for the unused days.
3. The car and the rental
The contract states the model, year, plate, VIN and odometer reading at hand-over, the start and end date and time, and the places of hand-over and return. Mileage is unlimited. The car is used within the territory of Vietnam only. It is equipped with GPS and a dashcam, and the renter consents to their operation during the rental.
4. Price and payment
The total rental price includes VAT 7%, the services and options chosen, and the situational fees applicable to the booking (delivery, one-way return, hand-over outside office hours, booking less than 24 hours before hand-over). The total is final: no further rental charges arise unless the terms change by agreement. Prices are fixed at booking.
The total is paid in parts, each as a separate transaction: the booking advance (counted toward the total; non-refundable), the rental balance, and the security deposit. The processing fee of the chosen payment method is added and is not refundable. If "pay on pickup" was chosen, the price includes the pay-later premium shown at booking. The contract is offered for signature once the total and the deposit are paid in full.
5. Options and limitation of liability
The contract lists the options and services included. Under the protection plan chosen at booking, VinRent limits the renter's liability for damage to or loss of the car to the excess stated for the plan, per incident, provided the use and incident rules are observed. This limitation is a contractual waiver granted by VinRent and is not an insurance product; VinRent is not an insurer.
The limitation is void and the renter bears the actual damage in full in case of: driving under the influence of alcohol (zero tolerance) or drugs; an unapproved driver; use contrary to section 8; leaving the scene of an accident; failure to follow the incident procedure; deliberate damage or gross negligence.
6. Changes, extension, early return
Extension, change of dates, services or options is by mutual agreement, is recorded in the booking and is paid at the rates in force at the time of the change, as a separate transaction; until agreed, the original terms apply. Early return, or non-use of paid days, services or options, gives no refund or credit. VinRent makes no additional charges except as set out in this contract.
7. Cancellation and no-show (before hand-over)
Cancellation is free of charge up to the number of hours before hand-over stated in the contract (currently 2 hours). Amounts paid toward the rental above the advance are refunded; the advance is retained. On later cancellation or no-show, all amounts paid toward the rental are retained. The security deposit is refunded in full in either case. Payment processing fees are not refunded. Refunds go to the original payment method.
8. Use of the car
The renter shall: drive personally, or through an approved driver, holding the licence required; observe Vietnamese traffic law, with zero alcohol and drugs; not sublet the car and not use it for taxi or ride-hailing, competitions, driving lessons, towing or off-road driving; use the car within Vietnam only; not smoke in it; keep it locked and the keys and documents safe (loss compensated at the documented cost of replacement); return it in the condition received, normal wear excepted; and bear all parking, toll and traffic charges arising during the rental.
9. Traffic violations and contractual penalties
Violations are established, among other things, from GPS and dashcam records. Independently of state fines — which the renter bears in full, including those delivered after return — the renter pays VinRent contractual penalties: speeding up to 10 km/h over the limit — 1,500,000 VND; 10–20 km/h — 3,000,000 VND; 20–35 km/h — 12,000,000 VND; over 35 km/h — 18,000,000 VND; running a red light — 40,000,000 VND. VinRent may terminate the rental without refund in case of dangerous driving.
10. Security deposit
The deposit is paid online or in cash at hand-over. It secures the renter's obligations (excess, fines, penalties, late return, lost keys or documents). Deductions are made only against documented items, with an itemised statement given to the renter. The deposit is refunded, less documented deductions, within the number of business days stated for the chosen plan after the car is returned, to the original payment method (in cash, if paid in cash). State fines notified after the refund may be claimed separately.
11. Hand-over, return, incidents
The contract takes effect on hand-over of the car; hand-over and return are video-recorded and the renter confirms having inspected the car. Risk passes to the renter for the rental period. Late return: up to 2 hours after the end time is free; beyond that, each started 24 hours is charged as a full rental day at the booking rate. In an accident or damage: ensure safety, call VinRent (+84 258 730 0336) and, where required, the police (113); do not move the car until instructed; provide photos and video. Failure to follow this procedure voids the limitation of liability.
12. Personal data
VinRent processes the renter's data (identity, contact, licence, payment references, GPS and dashcam records) solely to conclude and perform the contract and as the law requires, in accordance with the Privacy Policy.
13. Final provisions
The contract is governed by the law of Vietnam; disputes are resolved by negotiation, then by the competent court of Khánh Hòa province. The Terms of Service form an integral part of the contract; in case of conflict, the contract prevails.
